Welcome to whitegraphics.com (the “Site”), operated by White Graphics Inc. (“White Graphics,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to be bound by these Terms of Use (the “Terms”). If you do not agree to these Terms, do not use the Site.

1. Eligibility and Acceptance

By using the Site, you represent that you:

  • Are at least the age of majority in your jurisdiction, and
  • Have the authority to enter into these Terms on your own behalf or on behalf of the organization you represent.

If you are using the Site on behalf of a company or other legal entity, “you” refers to that entity.

2. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above.

Your continued use of the Site after any changes constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, stop using the Site.

3. Services and Information on the Site

The Site provides information about our packaging, printing, labeling, prototyping, and related services (the “Services”), along with case studies, resources, and contact forms.

  • Informational only. Content on the Site is for general informational purposes and does not constitute a binding quote, offer, or contract.
  • Quotes and orders. Any quotes, estimates, purchase orders, or service agreements are governed by separate written terms provided at the time of engagement, not these Site Terms.

4. Permitted Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  1. Use the Site in any way that violates any applicable law or regulation.
  2. Attempt to gain unauthorized access to any portion of the Site, our servers, or any systems connected to the Site.
  3. Interfere with or disrupt the operation of the Site, including by introducing viruses, malware, or harmful code.
  4. Use any robot, scraper, spider, or other automated means to access the Site for any purpose without our express written permission.
  5. Reverse engineer, decompile, or otherwise attempt to obtain the source code of any software used in connection with the Site.
  6. Use the Site to send spam or other unsolicited communications.

We reserve the right to suspend or terminate your access to the Site if we believe you have violated these Terms.

5. Accounts and Subscriptions (If Applicable)

Some parts of the Site may allow you to create an account, subscribe to a newsletter, or submit information.

You agree to:

  • Provide accurate, current, and complete information.
  • Maintain and promptly update that information.
  • Maintain the confidentiality of any login credentials and be responsible for all activities that occur under your account.

We may suspend or terminate your access to any account or subscription at our discretion.

6. Intellectual Property

Unless otherwise noted, all content on the Site—including text, graphics, logos, images, photographs, videos, icons, software, layouts, and overall design (collectively, the “Content”)—is owned by or licensed to White Graphics and is protected by copyright, trademark, and other intellectual property laws.

You may:

  • View the Site and print or download a single copy of pages from the Site for your own internal, non-commercial use related to evaluating or using our Services.

You may not:

  • Reproduce, distribute, modify, adapt, publicly display, publicly perform, republish, or create derivative works from the Site or any Content, except as expressly permitted by these Terms or with our prior written consent.
  • Use any trademarks, logos, or trade dress displayed on the Site without our prior written permission.

7. User Content and Submissions

The Site may allow you to submit information, files, or other content to us (collectively, “User Content”), for example via contact forms, file uploads, or email.

By submitting User Content, you:

  • Represent and warrant that you have all necessary rights to submit that content, and
  • Grant White Graphics a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display the User Content solely for the purpose of operating, evaluating, and providing our Services to you or your organization.

We do not treat User Content submitted through the Site as confidential unless we specifically agree otherwise in writing or are required to do so by law. However, we handle customer data in accordance with our privacy practices (see Section 9 below).

Do not submit any sensitive personal information (such as social security numbers, payment card numbers via plain forms, or medical data) through generic Site forms.

8. Third-Party Links and Resources

The Site may contain links to third-party websites or resources that are not owned or controlled by White Graphics.

  • We provide these links for convenience only.
  • We do not endorse or assume responsibility for any third-party sites, content, products, or services.
  • Your use of third-party sites is at your own risk and subject to those sites’ own terms and policies.

9. Privacy

Your use of the Site may involve the collection and processing of certain personal information (for example, when you submit a contact form or sign up for a newsletter).

We use such information to:

  • Respond to your inquiries;
  • Provide you with information about our Services; and
  • Operate and improve the Site.

10. Disclaimers

To the fullest extent permitted by law, White Graphics disclaims all warranties, express or implied, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
  • Any warranties arising from course of dealing or usage of trade;
  • Any warranties that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components;
  • Any warranties regarding the accuracy, completeness, or reliability of any Content.

Your use of the Site is at your own risk.

11. Limitation of Liability

To the fullest extent permitted by law:

  • White Graphics and its owners, officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to your use of, or inability to use, the Site or any Content, even if we have been advised of the possibility of such damages.
  • Our total aggregate liability to you for any and all claims arising out of or related to the Site or these Terms will not exceed one hundred U.S. dollars (US $100).

Some jurisdictions do not allow limitations of liability for certain types of damages, so some of the above limitations may not apply to you. In those cases, our liability will be limited to the fullest extent permitted by applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless White Graphics and its owners, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Site;
  • Your violation of these Terms; or
  • Your infringement or violation of any rights of another person or entity.

We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.

13. Governing Law and Jurisdiction

These Terms and your use of the Site are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.

You agree that any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in DuPage County, Illinois, and you consent to the personal jurisdiction of such courts.

14. Termination

We may, in our sole discretion and without prior notice, suspend or terminate your access to the Site (in whole or in part) for any reason, including if we believe you have violated these Terms.

Upon termination:

  • Your right to use the Site will immediately cease.
  • The following provisions will survive: Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law and Jurisdiction, and any other terms that by their nature should survive.

15. Miscellaneous

  • Entire Agreement. These Terms constitute the entire agreement between you and White Graphics with respect to your use of the Site.
  • Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
  • No Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
  • Assignment. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
